Terms of Use

By downloading, installing, or using WordMatch (the "App"), you agree to be bound by these Terms of Use ("Terms"). These Terms form a legally binding agreement between you and WordMatch ("we", "our", or "us").

If you do not agree to these Terms, do not download or use the App. If you are under 13 years of age (or under 16 in the EEA), you must have your parent or guardian's consent before using the App.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial entertainment purposes.

This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or any content within it.

You agree not to:

• ✕Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• ✕Modify, adapt, translate, or create derivative works based on the App
• ✕Use the App for any unlawful, harmful, or fraudulent purpose
• ✕Attempt to gain unauthorized access to any part of the App or its servers
• ✕Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software
• ✕Interfere with or disrupt the integrity or performance of the App or its servers
• ✕Collect or harvest any data from the App without our express written consent
• ✕Impersonate any person or entity or misrepresent your affiliation with any person or entity
• ✕Upload or transmit viruses or any other malicious code
• ✕Use the App in any manner that could damage, disable, or impair the App

The App is free to download and play. Optional in-app purchases are available for virtual items, cosmetic upgrades, and power-ups ('Virtual Items').

All purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms and refund policies. We do not process payments directly.

Virtual Items have no real-world monetary value and cannot be exchanged for cash or transferred between accounts.

We reserve the right to modify, manage, control, or eliminate Virtual Items at any time without liability to you.

Refund requests must be submitted directly to Apple or Google through their respective support channels.

The App and all of its content — including but not limited to text, graphics, logos, icons, images, audio clips, game mechanics, and software — are the exclusive property of WordMatch and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works from, or otherwise exploit any content from the App without our prior written permission.

The WordMatch name, logo, and all related marks are trademarks of WordMatch. You may not use these marks without our prior written consent.

Creating an account is optional. If you choose to create one, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update it as necessary.

You must not share your account with others or allow others to access your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in cheating, or are inactive for an extended period.

You may delete your account at any time through the App's Settings menu or by contacting us.

The App may send push notifications to your device about daily challenges, streaks, and updates. You can opt out of push notifications at any time through your device's notification settings.

We will not send marketing communications without your consent where required by applicable law.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that defects will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WORDMATCH, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $10 USD if you have not made any purchases.

Some jurisdictions do not allow the limitation of liability for certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless WordMatch and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of those third parties. Accessing third-party links is at your own risk.

The App uses third-party SDKs (such as Firebase) subject to their own terms of service. By using the App, you also agree to comply with those terms where applicable.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class or representative action.

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.

Upon termination, your license to use the App will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

You may stop using the App at any time by uninstalling it from your device.

We may update these Terms from time to time. When we make material changes, we will update the 'Last Updated' date and may notify you via push notification or in-app message.

Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
